LINCOLN – A Winnebago man serving time for a brutal assault on a Norfolk man is getting a slightly lighter sentence.
The Nebraska Court of Appeals on Tuesday vacated the restitution portion of Luke St. Cyr’s sentence. Sr. Cyr was sentenced to 40 to 50 years in prison in March of 2017 for the assault of man outside of a Norfolk bar in October of 2016. He was also ordered to pay $100,000 in restitution to the victim.
St. Cyr appealed his sentence, arguing that it was excessive and that his attorneys were ineffective.
In their ruling, the appellate court said they had no problem with the length of the sentence, but said the court didn’t meaningfully consider whether or not St. Cyr would be able to pay restitution, vacating his $100,000 fine.
