Nebraska City Preacher Asks For Release To Get More Exercise

NEBRASKA CITY – District Judge Julie Smith rejected Larry Mullins’ plea for a lower bail Wednesday and took his motion under advisement to interview a 10-year-old girl the state alleges as a victim of sexual assault.

Mullins’ attorney said the 69-year-old Nebraska City preacher has developed a blood clot in his leg, which could be fatal. He asked to reduce Mullins’ $750,000 bond so he can be released to undertake exercises in his back yard.

The Otoe County Detention Center reports that it follows state requirements to provide inmates with opportunity to exercise one hour a day five days  a week. An indoor recreation area is available daily and an outdoor facility less frequently.

The detention center said it has also provided Mullins with an extra mat to help him elevate his feet while resting.

Judge Smith said the state alleges serious crimes over five years and agreed with County Attorney David Partsch that the bond is appropriate as set.

Partsch also objected to the defense’s motion to take the deposition of the child witness. Partsch said the girl has already been interviewed by the Child Advocacy Center, so an additional interview is not necessary.

He asked that if the court permits the deposition, that the child’s court-appointed advocate be allowed to be present.

The judge took that matter under advisement and scheduled a pre-trial conference for Sept. 26.
